ACCUSED OF DOMESTIC ASSAULT

Things you should know

  • Your only real source of information is your attorney. The clerks are not required to give you any information
  • You will be required to leave the residence until there is a court hearing no later than 15 days after Petition is filed
  • If the court finds that a full order should be granted, the order will last from 6 months to a year
  • If a Petition is granted against you, you will not be able to obtain a permit to carry a concealed weapon so long as the Order of protection is in effect.  571.101.2(10) R.S.Mo.
  • The order can be modified
  • By agreement of both parties, the order can be dismissed
  • You must be served at least 3 days before the hearing
  • Court can order child support be paid after hearing
  • Court can order maintenance to a spouse after hearing
  • Violation of the Order of protection is a Class A misdemeanor (455.538 R.S.Mo) -(jail for more than 6 months). If you have a prior conviction of violating an Order it is a Class D Felony. (jail up to 10 years)
