MEDIATION
Mr. Piedimonte is a certified mediator having received training in
both civil and domestic mediation. Mediation is an alternative to
litigation. Parties engage a mediator to assist them in resolving their
disagreements by finding creative and useful solutions. The mediator is
neutral. He does not favor either side and does not pass judgment on
either party. The goal is to find solutions. The process is
confidential. Any information that may be disclosed between the parties
and the mediator is not admissible in court proceedings. The mediator is
ethically bound not to disclose any information discussed in mediation
to anyone including the parties' attorneys or the Courts unless both
parties agree. Parties can disagree with respect without being
afraid to offer their point-of-view. The mediator is also
ethically bound to not represent either party if they seek legal counsel
after a mediation session.
Mediation can work with or without attorneys. Often times, parties
will take their agreement to their respective attorneys and have the
attorneys review the terms and put the final agreement into a
separation agreement. Parties may also choose to mediate their
concerns before hiring counsel. The process is substantially cheaper.
Each party can agree how much time they will devote to mediation in
advance and thereby contain their costs. If the parties find
mediation is successful and they have additional concerns, they can
agree to schedule additional time for mediation.
