The Missouri Department of Labor, Division of Worker's Compensation has prepared a PowerPoint presentation setting out recent changes in the law. It is not intended to answer questions to any specific case but rather to give an overview of issues that have been addressed in the new worker's compensation law. Go to the site.
The basic formula for worker's compensation comes from a disability rating. An examining doctor will rate the part of your body that is injured. You will receive 66 2/3 percent of your average weekly wage (up to a certain maximum) times the disability rating. Whether you agree with the rating from the company doctor or understanding the way the formulas are calculated, your attorney can help you maximize your recovery through the process of your claim. Attorney's fees are set by statute at 25% of the amount recovered subject to certain exceptions where fees cannot be charged. After your injury, consider discussing the worker's compensation claim with one of our attorneys. You will gain a better understanding of the process. You are under no obligation to hire the firm and you will not be charged for the initial appointment.
